1. Binding Contractual Agreement
These Terms and Conditions (the "Terms") represent a binding, enforceable contract entered into by and between you (the "User") and MS Digits Spółka z Ograniczoną Odpowiedzialnością (frequently abbreviated as MS Digits Sp. z o.o.), a limited liability company incorporated, registered, and operating pursuant to the laws of Poland (the "Company").
By downloading, installing, launching, creating a profile, or interacting with the StepMe application, you explicitly confirm that you possess the legal capacity to contract and that you accept these Terms in full. If you object to any structural term, rule, or clause presented herein, your license to access the platform is revoked, and you must delete the Application from your mobile terminal immediately.
2. Proprietary Intellectual Property Rights
The brand asset name StepMe, all compiled application binaries, dark and light user interface layouts, minimalist graphics, visual styles, synchronization plugins, backend service integration layers, proprietary algorithms, database records, and trade symbols are the exclusive, undivided intellectual property of MS Digits Sp. z o.o..
The User is strictly prohibited from executing the following behaviors:
- Decompiling, disassembling, reverse engineering, or attempting to discover or extract the source code or underlying architecture of the Application or its connected APIs.
- Modifying, copying, translation-mapping, or framing any portion of our visual interfaces or backend routes.
- Constructing derivative applications, alternative fitness clients, or scraper mechanisms designed to extract structural elements from the Service.
3. Account Management, System Integrity, and Device Boundaries
Accessing global, pro, or friend leaderboards, tracking historical insights, or verifying reward distribution metrics requires the creation of an active profile utilizing our authentication pipelines.
- Security Stewardship: The User remains independently liable for preserving the access keys, passwords, and security hooks of their authentication profiles. Actions validated by your authentication profile are legally imputed to you.
- Modified Environment Exclusion: The Company strictly prohibits running StepMe on rooted, jailbroken, or technically altered operating systems. Bypassing sandbox security architectures breaks hardware attestation protocols. The Company explicitly reserves the unilateral right to deny server connection, restrict access parameters, or permanently suspend any profile detected interacting via a modified operating system environment.
4. Fair Play, Verification Systems, and Disqualification Rules
StepMe manages public leaderboard environments and awards incentives to high-performing players. To protect sportsmanship, the Company uses background data auditing systems and anti-cheat validation techniques.
- Anti-Cheat Verification: The Company utilizes proprietary data verification checks to flag simulated step generation, automated device-shaking mechanics, system timing overrides, API injection, or any other manual or digital artifice intended to report fraudulent fitness metrics. Please note: The Service verifies fitness data integrity through device-based movement metrics and does not use, track, or query physical GPS tracking vectors.
- Discretionary Action: If our verification workflows or anti-cheat triggers detect abnormal movement sequences, impossible pacing patterns, or suspicious account metrics, the Company maintains the absolute, unreviewable right to strip your leaderboard ranking, reset your step logs, exclude you from reward pools, or permanently terminate your account framework without notice, justification, or liability.
5. Premium Services, Subscription Models, and Payments
StepMe is delivered as a Freemium software experience. Access to special tiers, including the StepMe "Pro" Leaderboard ecosystem, requires continuous subscriptions or individual In-App Purchases (IAP).
- Clearing Portals: Financial billing, transactions, and continuous plan management are cleared and handled through the infrastructure of Apple App Store Billing or Google Play Billing systems. The Company does not hold or log payment card numbers.
- Store Cancellation Precedence: Active subscription services auto-renew automatically unless you terminate the arrangement inside your native Apple or Google OS subscription panels at least 24 hours prior to the close of the current billing cycle. All refund claims, billing disputes, or transaction adjustments must be directed exclusively to the app stores. The Company assumes no direct transactional liability and will not process cash or electronic currency refunds.
6. Virtual In-App Economy Rules ("Sparks")
The Application features a gamified in-app token mechanic known as Sparks, designed strictly for user entertainment and competitive execution.
- Zero Real-World Value: Sparks represent virtual gameplay indicators. They do not constitute electronic money, digital currency, tokens, or financial instruments. They have zero real-world value. Sparks cannot be sold, bartered, exchanged between users outside official competitive challenge features, or redeemed for physical currency, real-world assets, or cash options from the Company.
- Challenge Fees and Ecosystem Rakes: Within head-to-head (1v1) or group challenges, users pool entry metrics of Sparks. The verified winning participant receives the total prize pool. The Company explicitly reserves the right to deduct a platform maintenance fee ("rake" or house cut) from the total pool of Sparks prior to distributing the remaining tokens to the challenge winner.
- Unconditional Forfeiture Policy: If a User closes their account profile, or if the Company bans an account due to anti-cheat system flags or violations of these Terms, all remaining or purchased Sparks attached to that profile are immediately and completely forfeited without any right to valuation, balance restitution, or legal compensation.
7. Limitation of Liability & "As-Is" Service Delivery
This section limits the Company's liability under applicable statutory frameworks:
- As-Is Scope: StepMe is delivered strictly on an "as is" and "as available" basis. The Company explicitly disclaims warranties concerning service availability, continuous server uptime, plugin performance, backend connectivity, or sync consistency.
- Data and Network Dependencies: The Application relies on software lines controlled by third-party vendor frameworks (Apple HealthKit and Google Health Connect) and mobile cellular providers. The Company holds no liability for unlogged step history caused by OS exceptions, background thread termination, or battery drain. Any network data charges, usage overages, or international roaming expenses incurred while running StepMe are the exclusive financial responsibility of the User.
- Service Modification Rights: The Company retains the absolute right to adjust, rebalance, update, restrict, pause, or terminate the Application, including its virtual currency mechanisms and leaderboards, at any time, for any reason, without notice or legal or financial liability to any User.

These Terms and Conditions, alongside any legal claims or conflicts arising from or related to the use of the Service, shall be governed by, interpreted, and resolved exclusively in accordance with the substantive laws of Poland, without regard to choice of law provisions. Any legal actions or proceedings arising under these Terms shall be submitted exclusively to the competent common court having territorial jurisdiction over the registered seat of MS Digits Sp. z o.o. in Poland.
